Don’t spend a fortune and then regret it!

Financial arrangements are a critical element of every divorce and can sometimes be the most contentious.

Thanks to our adversarial divorce process, divorcing couples can often fritter away significant amounts arguing about who gets what.

That’s part of the reason I trained as a mediator – to provide an independent voice, calm things down and try to resolve issues and disputes with dignity; so all parties can continue with their lives as quickly as possible, without too much emotional, financial and psychological harm.

What happens if we can’t reach a financial agreement?

If you cannot reach an amicable agreement, then I can guide you through the process for financial disputes.

Appeals and setting aside orders

If your case has included a procedural irregularity, serious misconduct such as fraud, material nondisclosure or mistake I can advise you on the best way forward and help you get permission to appeal.

Variation

I have experience of supporting clients in the case of material change of circumstances or professional negligence, and how this may be seen by the court.

Financial dispute resolution

This is a multi-stage process featuring much paperwork and attention to detail.

If communication fails, then your next port of call is a Financial Dispute Resolution (FDR) through the court. This starts with form A1. You’ll then get a date for the First Appointment – the FA. (So many acronyms… sorry). At this stage, it’s time for the dreaded form E1 – the document for full financial disclosure. I can help you with all these forms as they are stressful and time consuming to complete. I will have to have sight of these documents in order to be able to help you:

  • Income
  • Pensions & Cash equivalent Transfer Values (“C.E.T.V” Investments)
  • Imminent Inheritances
  • Life policies
  • Property valuations

The next stage is more paperwork, including your relationship chronology, statement of issues, questionnaire and form G. I can talk you through, and help you with, all of this.

Now it’s time for me to give you my legal opinions on your current situation, the evidence I have, your priorities, tactics I should deploy and the possibility of settlement. I am here to help you, and on your side.

The end of this process is the FDR – Financial Dispute Resolution hearing. I will help you prepare for this day, so you are in a good as position as possible to get what you want. The day ends with a consent order detailing your financial agreement.
